CEQA
requires
mitigation
measures
to
be
enforceable.
Thus,
all
mitigation
measures
set
forth
in
the
Draft
EIR
require
“real
actions”
to
be
taken
at
various
points
in
the
planning,
engineering
design,
and
development
of
the
Baylands.
A
Mitigation
Monitoring
and
Reporting
Program
(MMRP)
has
been
developed
to
ensure
that
all
mitigation
measures
are,
in
fact,
implemented.
The
MMRP
can
be
found
in
Chapter
4.0
of
this
Final
EIR.
In
addition,
see
Master Response

for
a
discussion
of
the
enforceability
of
mitigation
measures.

impacts
to
the

character
of
the
site
and
its
surroundings.

sets
forth
design
guidelines
that
all
subsequent
development
within
the
Baylands
must
meet,
one
of
which
is
to
provide
for
variations
in
building
height.
As
noted
in
Master Response
1,
all
subsequent
development
projects
within
the
Baylands
will
be
reviewed
to
ensure
compliance
with
the
design
guidelines
set
forth
in
this
Mitigation
Measure,
and
a
specific
finding
that
proposed
development
is
consistent
with
the
design
guidelines
set
forth
in
Mitigation
Measure
4.A-3
will
be
required
prior
to
approval
of
such
development.

Mitigation
Measure
4.A-4a,
which
addresses
nighttime
lighting
is
based
on
the
International
Dark
Sky
Association’s
Dark
Sky
philosophy
that,
while
a
community’s
lighting
system
needs
to
adequately
illuminate
and
provide
for
the
safety
of
vehicular
and
pedestrian
movement,
outdoor
lighting
should
only
be
used
where
needed
with
lighting
levels
kept
to
the
minimum
necessary.
This
comment
incorrectly
asserts
that
the
Draft
EIR
proposes
cobra-head
lighting.
Mitigation
Measure
4.A-4a
states
that
street
lighting
shall
be
comprised
of
shorter,
pedestrian-scaled
fixtures,
rather
than
tall
cobra
head
fixtures.
The
entertainment
venues
proposed
in
the
DSP-V
venue
will
be
required
to
comply
with
the
same
nighttime
lighting
standards
as
other
uses
in
other
scenarios.
While
the
proposed
entertainment
venues
in
the
DSP-V
scenario
will
entail
a
substantial
amount
of
night
lighting,
the
requirements
set
forth
in
Mitigation
Measure
4.A-4a
applying
to
all
uses
will
reduce
the
nighttime
lighting
impacts
to
less
than
significant.
These
specific
requirements
include:
Maximum
illumination
at
the
property
line
of
any
use
shall
not
exceed
0.1
foot-candles
on
business
properties
and
0.05
foot-candles
on
residential
properties
and
open
space
areas.
Onsite
lighting
of
site-specific
development
within
the
Project
Site
shall
result
in
zero
direct-beam
illumination
leaving
the
site.
